General Terms and Conditions

  1. Introduction

    1. The terms and conditions of PresentForever, hereinafter "platform", constitute a legal and binding agreement on users who accept it.
    2. Users will be able to register on the platform with the aim of creating and designing websites.
    3. The use of the platform by its visitors and users will be limited under the conditions of the platform owner.
    4. There may be clauses in this agreement that do not affect you. Please read it carefully as well.
    5. The ownership of the platform is governed by Andreu Pérez, hereinafter "owner", and anyone who uses the platform as a user must accept this agreement in order to avoid conflicts, so that the rules, clauses or conditions written below.

  2. General

    1. The platform is committed to providing a service to its visitors and users by allowing them to create and design websites.
    2. The platform reserves all the rights it considers without requiring the approval of its users or external entities.
    3. The Parties undertake, reciprocally, to ensure the maintenance of the confidentiality of all commercial secrets, technical knowledge and other information that they become aware of as a result of the commercial relationship that is the subject of this contract, and may not use any of these. confidential information, unless expressly authorized by its respective owner. Accordingly, each party will ensure that its partners, affiliated companies, directors, employees and/or any other person under its responsibility (direct or indirect) keep secret all the terms and conditions of this Agreement.
    4. The platform may reproduce, display or teach advertising on its websites if it so decides without prior authorization.
    5. Every user is obliged to respect the use of the platform and agrees not to invade or compromise the security or privacy of the users of the platform or their data.
    6. If a user or visitor does not respect any of the conditions in this contract, they may be penalized without viewing the content of the platform or using it.

  3. General provisions

    1. Payments made by users to the platform are governed by the Stripe payment platform and PresentForever will not be responsible for losses, falls or negligence of any event that harms PresentForever.
    2. The platform will not be responsible for interruptions or errors that occur in the transmission of data over the Internet.
    3. The platform will not allow the registration of more than certain users based on their IP address.
    4. The websites created by free visits will remain associated with users when they register, as long as they maintain their IP address and do not exceed the established limit of website ownership per user.

  4. Domains

    1. The platform has a service that provides domain names with a ".com" extension.
    2. The price of this service will be displayed on a web element close to your contract.
    3. The service is not permanent and the duration will be by default 1 year from the date of contracting, unless another term is stipulated between the parties to the agreement.
    4. Between contracting, activating and subsequently using the domain, there may be a period of time in which it is not available for use. Please be patient and wait at least 48 hours. If more time passes, contact the platform to review its status.
    5. After purchasing the domain service, the status of your new domain will be "Pending" and after a maximum of 48 hours it will change to "Active".
    6. It is not possible to cancel, modify or return the domain service.
    7. If a domain reaches its expiration date without having been renewed, it is possible that the user who acquired it may lose possession because it was acquired by another person or entity.
    8. Under prior agreement between both parties to the agreement, domains may only redirect to PresentForever websites.
    9. A domain cannot be redirected to a PresentForever website of a user other than the one who purchased the domain unless the platform accepts it in writing in advance.
    10. Domains are registered by an external provider.

  5. Subscription plans

    1. Users of the platform can purchase a subscription plan to increase the benefits for designing their websites.
    2. The price of these subscription plans will be displayed on web elements in the vicinity of your contract.
    3. The periodicity of the subscription plans will be monthly, unless another periodicity is indicated.
    4. Users will be responsible for canceling their subscription plans by clicking on the free plan and confirming their choice.
    5. Users agree not to return money for a subscription plan under the premise of having previously tried the platform service for free with their free plan.

  6. Jurisdiction

    1. The parties elect, expressly waiving any other jurisdiction, no matter how privileged it may be, the jurisdiction of the city of Valencia (Spain), as the only competent jurisdiction to resolve any doubt or controversy arising from this Agreement.
    2. You are also informed that there is a conflict resolution platform created by the European Union and signed by the Member States, and you can use the following link http://ec.europa.eu/odr.

  7. Termination

    1. In the event that the user fails to comply with any of the points of this agreement, the platform reserves the right to take legal action, claim compensation and prohibit access to the platform.
